In a significant move to address the backlog of cases exceeding five years, the Jammu and Kashmir High Court has rolled out a comprehensive set of guidelines for the District Judiciary across the Union Territories of Jammu & Kashmir and Ladakh. The newly introduced framework includes the establishment of the District Case Management System Committee.
Key Highlights of the New Guidelines:
- District Case Management Committee Formation: Each district will now have a Case Management Committee led by the Principal District Judge, with participation from a senior Additional District Judge and a Senior Civil Judge (preferably the Chief Judicial Magistrate). This committee will supervise case management and may include judicial officers, Bar Association members, government pleaders, and public prosecutors. Monthly meeting minutes are to be forwarded to the Member Secretary of the State Case Management System Committee for oversight.
- Monthly Review Meetings: The committee will convene monthly to assess the progress of long-pending cases and recommend measures for expedited resolution. Judicial officers who are not stationed at the headquarters can join these meetings virtually.
- Case Monitoring and Distribution: The committee will prioritize the oldest cases and ensure they are distributed fairly among judges, with more complex cases allocated to experienced judges to promote efficient handling.
- Ensuring Attendance: Efforts will be made in collaboration with district police and prosecutors to ensure that accused individuals and witnesses are present in court, minimizing delays caused by non-appearance.
- Merit-Based Disposals: The focus will be on disposing of cases based on their merits, avoiding dismissals for non-prosecution or ex-parte decisions unless absolutely necessary.
- Oversight by Chief Justice: The Chief Justice of the J&K High Court will oversee the implementation of these guidelines, ensuring accountability and effectiveness in case disposal.
This initiative aims to streamline case management processes, significantly cut down judicial delays, and enhance the overall efficiency of the judicial system in Jammu & Kashmir and Ladakh.
