SC Dismisses Rape Case Against Ex-Army Officer, Cites Pattern of False Allegations

In a significant ruling, the Supreme Court has quashed criminal proceedings against former Indian Army officer Rakesh Walia, declaring the allegations against him as unfounded. The bench found that the complainant had previously filed eight nearly identical cases against different individuals and failed to cooperate with investigators after lodging the FIR.

The Court observed that beyond the complainant’s statements, no substantive evidence supported the claims. Noting the pattern of repeated accusations, it described the case as an “abuse of the process of law” and ruled that the Delhi High Court should have exercised its authority to dismiss the charges earlier.

The complainant alleged that Walia spiked her drink during a meeting about a modeling assignment and assaulted her. However, Walia contended that their interaction was solely professional, related to the promotion of his books. The Supreme Court ultimately set aside the High Court’s order and dismissed the case entirely.
