Karnataka High Court Slams State for Allowing Protests Amid Supreme Court’s Review of Waqf Act

In a pointed reprimand to the Karnataka government, the High Court on Thursday expressed disapproval over the state’s decision to permit protests against the Waqf (Amendment) Act while the matter remains under the scrutiny of the Supreme Court.

Justice M. Nagaprasanna emphasized that the government should have refrained from approving such demonstrations, given the ongoing legal proceedings. “The State must consider that the apex court is actively reviewing the Waqf Act’s amendment, and protests of this nature should not be allowed,” he stated.

The Court further directed the authorities to ensure that protestors do not block roads, ordering that any demonstrations must occur solely at authorized locations with prior permission. “Protests concerning the Waqf Act can only take place if granted lawful permission, and they must not obstruct public roads,” the Court clarified. “Without official approval, no protest should occur.”

These remarks were made during the hearing of a petition filed by Rajesh A, a Mangaluru resident, challenging a notice from the local Police Commissioner. The notice restricted bus operations on a stretch of National Highway 73, citing a planned protest against the controversial Waqf law.

The Karnataka government informed the Court that the advisory had been updated, ensuring that traffic would proceed without disruption, though heavy and medium-sized vehicles were advised to take alternative routes.

The Court has scheduled the next hearing for April 23.
