Franchise Fallout: Delhi HC Blocks Patna Outlet from Using ‘Burger Singh’ Name

The Delhi High Court has stepped in to shield the brand identity of ‘Burger Singh’, barring a former franchisee from continuing to use the name after their agreement went up in flames.

Burger Singh, a homegrown burger chain running since 2013, found itself in court after a Patna-based outlet allegedly continued trading under the brand even after its franchise license was yanked. The deal, inked in 2023 for five years, was cut short in May 2025 when the outlet reportedly flouted several terms — including serving expired food, defaulting on payments for raw materials, and disabling CCTV surveillance.

Despite termination, the outlet was still allegedly riding on the Burger Singh name, prompting legal action. Justice Jyoti Singh didn’t mince words, stating a clear prima facie case had been established for immediate intervention.

The Court directed that the Patna outlet must immediately stop using the ‘BURGER SINGH’ mark or anything remotely resembling it until further orders. A local commissioner was also appointed with authority to enter the premises, seize infringing items such as signage, marketing material, and official documents, and file a report within two weeks.

With branding battles heating up across the food franchise world, this ruling signals a clear warning: breach the bun, and you’ll face the bench.
