No Exit from FIR: MP High Court Declines Congress Worker’s Plea Over Controversial Post on PM Modi

The Madhya Pradesh High Court has made it clear — a Facebook post questioning the Prime Minister’s intent in matters of national security is not walking away without scrutiny. A Congress worker’s attempt to have an FIR against him buried was firmly turned down, with the Court refusing to intervene while the investigation is still breathing.

At the heart of the controversy is Yadvendra Yadav, Congress member and Up-Sarpanch of Gram Panchayat Singhpur. He found himself in legal quicksand after allegedly uploading altered photos and a video on Facebook claiming that Prime Minister Narendra Modi had called off military action against Pakistan due to pressure from the neighbouring country. The post, laced with sensationalism, didn’t just stop there — it reportedly used inflammatory language against the Indian Armed Forces as well.

Justice Vishal Mishra, presiding over the plea, wasn’t moved by arguments suggesting the FIR was nothing more than a politically engineered attack. Instead, the Court observed that there was “sufficient material” already gathered by investigators to keep the case very much alive.

“The law permits interference in FIRs only under extraordinary circumstances — and this isn’t one of them,” the Court remarked. “The investigation is in progress, and the evidence, or lack of it, is a matter for the trial court to weigh.”

Yadav’s defense insisted the FIR was a tool of political vendetta, allegedly triggered by BJP loyalists. He maintained he had no malicious intent to tarnish the nation or its institutions. But the Court drew a firm line, stating that its jurisdiction does not stretch into interpreting facts or playing appellate reviewer of FIR details.

In short: the case stays. And for now, so does the heat.
