Supreme Court Overturns Bail for Olympian Sushil Kumar in Murder Case

The Supreme Court has rescinded the bail granted to Olympic wrestler Sushil Kumar, accused in the murder of fellow wrestler Sagar Dhankhad. This decision by a bench of Justices Sanjay Karol and Prashant Kumar Mishra effectively overturns the Delhi High Court’s earlier ruling from March 4. Kumar has been ordered to return to custody within one week.

A Grave Matter: The Court’s Reasoning

The Supreme Court’s judgment highlights several critical errors in the High Court’s decision. The Court emphasized that the high-profile nature of the case, the potential for Kumar to influence the trial, and his conduct during the investigation were not adequately considered.

Kumar, a celebrated figure in wrestling, was noted to have evaded arrest for weeks before his capture. The Court described the alleged crime as turning the national capital into a “criminal playground,” where individuals were abducted and subjected to a violent attack that led to Dhankhad’s death.

Furthermore, the Court pointed out Kumar’s significant public influence and the societal impact of his actions. Witnesses in the case had also formally expressed fear for their lives if Kumar were to remain free on bail.

The Pattern of Witness Tampering

The High Court had initially granted bail partly due to the prolonged nature of the trial and Kumar’s over three-year imprisonment. It also considered that Kumar had previously surrendered to jail after his interim bail periods expired.

However, the Supreme Court took a different view. It noted the State’s claim that a pattern of witnesses turning hostile emerged each time Kumar was on bail. While the Court did not definitively conclude Kumar was responsible, it acknowledged this pattern, noting that 28 out of 35 witnesses had turned hostile. This fact alone, the Court stated, “underscores the possibility of interference into the trial by the Accused.”

This pivotal finding ultimately led the Supreme Court to grant the appeal from Dhankhad’s family and revoke Kumar’s bail, sending a clear message about the gravity of the charges and the importance of a fair and uncompromised legal process.
