In a decisive move, the Delhi High Court has stepped in to shield Hero MotoCorp’s trademark turf, ordering an immediate stop to the use of the “Destiny” brand name by rival electric scooter makers.
The injunction, issued by Justice Tejas Karia, bars Urban Electric Mobility and Galaxy EV from selling or promoting scooters under the labels “Destiny,” “Destiny+,” and “Destiny Pro.” The court found that the names were too close for comfort when compared to Hero’s registered trademarks—“Destiny,” “Destini,” and “Destini Prime.”
Hero MotoCorp argued that the contested names were not only lookalikes but also soundalikes, designed to ride on the reputation it had built around its own products. To make matters worse, some defendants were allegedly also deploying the mark “Hero,” raising the risk of serious consumer confusion.
Justice Karia noted that Hero had established a strong prima facie case for protection and warned that continued misuse could cause “irreparable injury” to the company’s goodwill and market presence.
With the order in place, the defendants and anyone associated with them are barred from manufacturing, selling, advertising, or even displaying scooters under the disputed names across online or offline platforms.
For now, the Destiny road in India’s EV marketplace belongs squarely to Hero MotoCorp.
