The truce was not simple. The companies had been locked in contentious proceedings that crisscrossed India’s Supreme Court, the Madras High Court, commercial courts in Chennai, and international arbitration rooms in London. The disputes stretched over a year, blending commercial friction with intellectual property battles, including rights surrounding the well-known “Massey Ferguson” brand.
The final agreement consolidated a raft of settlements: exit arrangements, brand rights adjustments, and resolution of cross-border arbitration awards. The deal cleared the path for AGCO to step away from its long-standing partnership while ensuring disputes were finally put to rest.
A large team of advisors steered AGCO through the storm—crafting strategies, negotiating across multiple forums, and managing the global legal landscape. Alongside Indian counsel, leading international firms also weighed in on foreign law aspects and the London-seated ICC arbitrations.
