The Delhi High Court has drawn a firm line in the digital sand, stepping in to protect the personality rights of singer Jubin Nautiyal from what it described as tangible and immediate harm.
In an interim order delivered by Justice Tushar Rao Gedela, the Court restrained several artificial intelligence platforms, websites and e-commerce portals from exploiting the singer’s identity. The injunction covers the unauthorised use of his name, voice, vocal texture, singing style, image and overall likeness.
The directive goes further than a simple warning. It mandates the blocking and removal of links, videos, mobile applications and websites found to be misusing Nautiyal’s persona. AI-generated voice models, digital avatars, deepfakes, caricatures and synthetic imitations that echo his singing style are now explicitly barred.
Nautiyal had approached the Court alleging that generative AI and machine learning tools were being deployed to clone his voice and fabricate performances that he never delivered. The complaint pointed to face-morphed visuals, synthetic voice engines and even chatbots built around his persona — all operating without consent.
The Court noted that the potential damage to the singer’s reputation was neither speculative nor distant. Given his popularity and public standing, it held that the balance of convenience tilted decisively in his favour. Monetary compensation, it observed, would not adequately repair the injury if the misuse continued unchecked.
At an earlier hearing, the Court had questioned the territorial jurisdiction of the case, asking how the matter fell within its purview when Nautiyal is based in Uttarakhand and certain defendants were located overseas, including in Romania and the UAE. Despite those queries, interim protection has now been granted.
With this order, the message is unmistakable: in the age of algorithmic mimicry, a celebrated voice remains legally inseparable from the person it belongs to.
