India’s national consumer commission has directed the Lucknow Development Authority to determine the actual identity and dimensions of a disputed commercial shop before calculating its final price.
The purchaser was allotted a 12-square-metre unit but received possession of premises measuring approximately eight square metres. An inspection indicated that two shop numbers may have been interchanged before possession was delivered.
The commission partly allowed the development authority’s appeal, ruling that payment must correspond to the premises actually occupied. The purchaser must pay the outstanding principal with six per cent annual interest from the date of possession, after which the authority must execute the conveyance.
The decision reflects a practical approach to public-sector property disputes—government bodies cannot demand payment based on paperwork that conflicts with the physical asset delivered. At the same time, purchasers remain responsible for legitimate outstanding dues once the discrepancy is resolved.
