India’s Supreme Court has urged the Law Commission to examine legislation establishing a uniform system for money deposited in courts and tribunals.
Existing practices differ substantially among jurisdictions. Courts use different banks, investment instruments, withdrawal procedures and renewal arrangements. Those differences can produce unequal financial outcomes and generate secondary disputes over interest and accounting.
The court suggested a common platform through which judicial deposits could be pooled and invested appropriately. It also asked that international models be studied and financial and legal authorities consulted.
The proposal addresses an overlooked dimension of access to justice—the economic value of money held during prolonged litigation. A standardised framework could improve transparency, protect deposits against depreciation and reduce administrative burdens.
