Delhi Court Weighs Independent Probe Into Bar Council Assault

The Delhi High Court has reserved its decision on whether lawyers may directly seek an independent investigation into an alleged assault at the Bar Council of India.

The petitioners seek registration of a criminal case, preservation of surveillance footage and investigation by the Central Bureau of Investigation or another independent agency. They argue that political and institutional connections create concern about the neutrality of the Delhi Police.

The court’s immediate concern is procedural—whether the petitioners should first pursue remedies before a magistrate and whether all requested relief can be granted through criminal writ jurisdiction.

The dispute highlights the distinction between dissatisfaction with an investigation and legal grounds for transferring it. Independent investigations remain exceptional, though credible conflicts may justify outside scrutiny.
