The Telangana High Court has ruled that a father cannot be denied custody as a matter of course or treated merely as a source of financial support unless evidence shows that he is unfit or undeserving.
The dispute concerned a four-year-old girl brought to India while custody proceedings between her parents were pending in the United States. The Court directed her return, emphasising continuity, the existing foreign proceedings and the child’s welfare rather than automatic preference based on parental gender.
The ruling cautions against allowing sympathy for one parent to displace an individual assessment of the other parent’s caregiving role. Custody decisions must evaluate suitability, stability and the child’s interests on evidence.
