Delayed Medical Examination Cannot Defeat Disability Evidence

The Madhya Pradesh High Court has held that medical evidence of permanent disability cannot be discarded merely because the doctor examined a motor-accident claimant about a year after the crash.

The tribunal had rejected the disability evidence on timing alone. The High Court found that approach unsustainable, noting that the doctor’s testimony and certificate still required proper assessment.

Rather than reopen the entire compensation calculation, the court awarded an additional lump sum of ₹50,000 with interest at the rate fixed by the tribunal. Interest was excluded for the period from January 31, 2014 to August 13, 2024 because of delay attributable to the appeal.

The insurer was directed to pay the enhanced amount within two months. The decision was delivered on September 29, 2026.
