Probation Cannot Follow Grievous Assault and Adverse Antecedents

The Supreme Court has ruled that probation was inappropriate for offenders convicted of a grievous group assault where their antecedents and conduct were not adequately examined.

In its 7 October 2026 judgment, the court said the Allahabad High Court had released the accused on probation without properly addressing the gravity of the attack or relevant adverse material. The discretion to avoid imprisonment must be exercised on a reasoned assessment of the offence and the offender, it held.

The bench set aside the probation order and directed the accused to surrender within two weeks. It restored their criminal appeals before the High Court’s Lucknow Bench for reconsideration after they are taken into custody.
