The Gujarat High Court has held that a person cannot be declared an absconder without reliable material showing deliberate evasion of legal process.
In its 5 October 2026 decision, the court found that the proclamation proceedings rested on a police report that was later shown to be forged. It said the label “absconding” carries serious legal consequences and cannot follow from mechanical reliance on unverified service material.
The court quashed the proclamation order and directed the applicant to appear before the competent court. It also ordered criminal proceedings against the responsible police officer and called for statewide safeguards to ensure that future proclamation reports are authentic and properly verified.
