The Delhi High Court has restored a minority school’s appeal against a teacher’s dismissal, holding that the absence of a formal minority-status certificate was not by itself conclusive.
The court set aside the Delhi School Tribunal’s order and revived the appeal on the limited grounds available to a recognised minority institution. It directed the tribunal to decide the matter on priority, preferably within four months.
In a connected dispute, the court held that a teacher’s suspension lapsed because approval was not obtained within the statutory 15-day period. The Directorate of Education’s salary directions therefore remained operative, and the school must pay the balance suspension-period salary within eight weeks. The judgment was delivered on 13 October 2026.
