Bombay High Court Awards Compensation To Passenger Injured On Bus Footboard

The Bombay High Court has awarded ₹2,10,365 to an injured bus passenger, overturning dismissal of his compensation claim after finding fault with both the passenger and the moving bus’s driver.

Judge / Bench — Justice S.M. Modak.

Deciding Mohan Laxman Chavan’s appeal on 22 October 2026, the court said the tribunal had concentrated on his footboard position while overlooking the driver’s failure to take precautions when overtaking a stationary bus. Negligence could be inferred from the circumstances and oral evidence; police papers were not conclusive.

The Transport Manager and Director of Insurance must pay jointly and severally within twelve weeks, with 7.5% annual interest from the claim petition until realisation, deducting any no-fault payment.

Advocates appearing — Appellant — T.J. Mendon. Respondent 1 — Vedant Bende, instructed by Mandar Limaye. Respondent 2 — P.M. Bhansali with Arafat Siddique. Respondent 3 — Rashmi S. Tendulkar, Assistant Government Pleader.
