Allahabad High Court Seeks Centre And RBI Response On Comatose Patients’ Bank Funds

The Allahabad High Court has sought the Centre’s and RBI’s responses on a mechanism allowing dependants to access savings of patients in a coma, noting difficulties funding care and household needs.

Judge / Bench — Justices Ajit Kumar and Garima Prashad.

The 8 October 2026 order continued consideration of the issue despite the account holder’s death. The Centre and RBI must file officials’ affidavits addressing proposals or guidelines, after considering earlier court observations.

The State must present a concrete response; otherwise its Chief Secretary must appear personally. The court allowed the petitioner to seek succession for release of the deceased’s savings, directed RBI notice, and listed the matter for 6 November 2026. It did not grant general access to bank funds.

Advocates appearing — Petitioner — Raj Kumar Dhama. Respondents — Parshuram Chaubey, Satish Chaturvedi and C.S.C. (individual not named). Union of India — Vivek Kumar Singh, senior panel counsel.
