The Orissa High Court has appointed a mother as court guardian of her minor daughter’s property and conditionally permitted a sale of the minor’s lawful share.
Judge / Bench — Justice Sanjay Kumar Mishra.
The 7 October 2026 judgment clarified that the mother is not the natural or legal guardian of property under Mohammedan law; her authority flows from court appointment under the Guardians and Wards Act. The guardianship court must verify the exact share and current valuation, supervise prior compliance and bond requirements, protect the net proceeds in a court-approved investment in the minor’s name, and receive sale and account records.
