Delhi High Court Quashes Airport Cartridge Prosecution For Lack Of Conscious Possession

The Delhi High Court quashed an Arms Act charge-sheet over a single live cartridge found in an air passenger’s baggage, finding no conscious possession.

Judge / Bench — Justice Ravinder Dudeja.

The 16 October 2026 judgment distinguished physical custody from possession with awareness. No firearm accompanied the cartridge, and the FIR identified no suspicious circumstances indicating conscious possession. Continuing the prosecution would abuse the legal process. The charge-sheet and consequential proceedings in FIR 226/2022 at IGI Airport police station were quashed.

Advocates appearing — Petitioner: Shrey Sharawat, Ayush Tanwar, Ketan Saxena and Pradhee Dhingra, Advocates. State: Raghuinder Verma, APP, with SI Rajesh Kumar, PS-IGI Airport.
