JK High Court Quashes Costs Against Senior Advocate Without Hearing

The Jammu & Kashmir and Ladakh High Court quashed a tribunal order imposing ₹10,000 costs on Senior Advocate Jahangir Iqbal Ganai without giving him an opportunity to be heard.

Judge / Bench — Sanjeev Kumar and MA Chowdhary, Judges.

The 21 October 2026 order allowed WP(C) 3283/2026 against Mohd. Amin Dar and other respondents. The Court found a breach of natural justice over a small dispute that should have been resolved in open court. It urged judicial restraint when exchanges become heated and stressed advocates’ responsibility, particularly seniors’, to maintain dignity and decorum. Tribunal members did not attend the proposed mediation despite service and attempts to arrange virtual participation.

Advocates appearing — Respondents: Not named in the order.

Party in person — Petitioner Jahangir Iqbal Ganai.
