On the UT’s application to cancel interim bail, the Jammu & Kashmir and Ladakh High Court directed the Sessions Judge to decide the pending bail application finally within two weeks.
Judge / Bench — Justice Yash Paul Bourney
It discouraged prolonged interim bail orders during trial because keeping the application undecided impedes an aggrieved party’s effective challenge to a final bail determination. The UT was permitted to approach the trial court for custody if, as alleged, the earlier interim protection had expired without extension. The High Court did not itself cancel bail or adjudicate the accused’s entitlement to release. Counsel should establish the exact duration and extension history of interim protection and seek prompt disposal of the substantive application rather than assume that an unresolved interim order remains operative.
