Jammu & Kashmir and Ladakh High Court

Expired Marriage-Bail Request Disposed Of With Liberty To Seek Custody Parole

A Division Bench of the Jammu & Kashmir and Ladakh High Court disposed of a temporary-bail and preponement request because the daughter’s stated wedding dates had already passed; the applicant had not appeared when the matter was taken up beforehand.

Judge / Bench — Hon’ble Dr. Pushpendra Singh Bhati, Chief Justice, and Hon’ble Mr. Justice Rajesh Sekhri, Judge

It noted Rule 6 of the Jammu and Kashmir Suspension of Sentence Rules, 2020, governing custody parole for specified family events and emergencies, including for convicts whose appeals remain pending. The applicant was given liberty to apply to the competent authorities, which must verify the facts and decide strictly under the rule. No parole or temporary bail was granted. Counsel should distinguish the statutory custody-parole route, its limited duration and competent authority from appellate suspension of sentence, and support any rescheduled event through a current verified application.
