Enforce Existing Writ Direction Through Contempt, Not Repetitive Petition — J&K High Court

The petitioner complained of continuing electricity bills for a rice machine said to have been closed for a long time.

Judge / Bench — Hon’ble Mr. Justice Shahzad Azeem, Judge

An earlier writ petition on the same grievance had already resulted in a direction to the authorities to consider his case and pass a speaking order. The Jammu & Kashmir and Ladakh High Court held that alleged failure to comply with that existing direction did not justify a second writ petition on the same cause of action. The appropriate course was to invoke contempt jurisdiction. The fresh petition was dismissed as not maintainable, with liberty to pursue the remedy available in law. The ruling distinguishes enforcement of an existing judicial direction from seeking the same relief through repetitive writ proceedings.
