Madhya Pradesh High Court Quashes Case Over Barred Police Prosecution

The Madhya Pradesh High Court on 2 November 2026 quashed criminal proceedings against Rajesh Achaliya because prosecution required a written complaint from the public servant concerned.

Judge / Bench — Pavan Kumar Dwivedi, J.

In M.Cr.C. 18484/2026 (2026:MPHC-IND:30816), the Court applied Section 215 BNSS to the Section 223 BNS accusation. Adding a closely connected wrongful-restraint allegation could not circumvent that bar. The record, including the spot map, also failed to establish the restraint alleged. FIR 198/2024 at Palsud, the charge-sheet and the cognizance order in RCT 817/2024 were quashed.

Advocates appearing — Petitioner: Parv Birla; respondent State: Bhaskar Agrawal, Government Advocate.
