Supreme Court Revives Recovery Suit After Finding Repeated Debt Acknowledgments

The Supreme Court revived Yusuf’s recovery suit against Vigyapan Loke Delhi Advertising CGHS Ltd. on 6 November 2026, holding that the society’s balance sheets supported fresh limitation periods under Section 18 of the Limitation Act.

Judge / Bench — Vikram Nath, Judge (author); Augustine George Masih and Sandeep Mehta, Judges.

In 2026 INSC 1207, it read the accounts alongside cheque and reconciliation records connecting the debt to the original contractor. It held that the plaint should not have been rejected under Order VII Rule 11 CPC. The court left the amount actually owed and all merits questions for trial, cautioning that balance-sheet qualifications must also be considered.

Advocates appearing — Appellant: Not named in the judgment/order. Respondent: Not named in the judgment/order.
