Rajasthan High Court rejects interstate Scheduled Tribe reservation claim

The Rajasthan High Court dismissed Baria Sharmishtha Ben’s nursing-officer recruitment appeal on 5 November 2026, holding that migration from Gujarat did not carry Scheduled Tribe reservation benefits into Rajasthan.

Judge / Bench — Justices Vinit Kumar Mathur and Chandra Shekhar Sharma.

In D.B. Special Appeal Writ 1695/2025 (2026:RJ-JD:55282-DB), the court upheld consideration in the general category. The same tribe being recognised in both states did not establish entitlement; the recruitment advertisement also expressly required such treatment of migrant candidates.

Advocates appearing — Appellant: C.S. Kotwani. Respondents: N.S. Rajpurohit, Additional Advocate General, assisted by Kanchan Jodha.
