Delhi High Court Upholds BCD Vice Chairman’s Position Amid Degree Controversy

In a recent development, the Delhi High Court turned down a petition seeking the removal of advocate Sanjeev Nasiar from his role as Vice Chairman of the Bar Council of Delhi (BCD). The petition, brought forth by Naresh Chand Gupta, former President of the Delhi Bar Association, accused Nasiar of possessing a fraudulent law degree.

Justice Sachin Datta, overseeing the case, found no substantial evidence to justify Nasiar’s dismissal. However, the court directed the Bar Council of Delhi to forward Nasiar’s credentials to the Bar Council of India (BCI) for a thorough investigation. If discrepancies are discovered, the BCI is authorized to take appropriate measures.

Gupta’s petition also called for striking off the names of Nasiar and another advocate, Dalip Kumar Rana, from the BCD’s roster and filing a first information report (FIR) against them. While the court dismissed the plea against Nasiar, it urged the BCI to expedite the verification process concerning Rana’s enrollment.

A robust legal team represented all parties involved, with Advocate Rajiv Khosla and his colleagues advocating for the petitioner. The BCD’s defense was led by Sanjeev Sagar and his associates, while Senior Advocate Sacchin Puri spearheaded Nasiar’s defense. Additionally, ASG Chetan Sharma, alongside a team of advocates, represented the BCI, and Advocate HS Kohli stood for Dalip Kumar Rana.
