In a recent legal development, a Haryana court in Panchkula has granted bail to Raj Singh Gehlot, the managing director of Ambience Developers, accused of misleading a couple in a commercial license scam. Gehlot, known for his association with Ambience Mall, faced allegations of defrauding the couple by promising to develop a housing colony but instead obtaining a commercial license.
Special Judicial Magistrate Anil Kumar Yadav approved the bail, requiring Gehlot to post a bond of ₹1,00,000. The court’s decision emphasized that there was insufficient evidence to suggest Gehlot posed a flight risk or intended to evade justice, noting that “bail is a rule and jail is an exception.”
The case was brought by Amitabha and Deepika Sen, who accused Gehlot of deceitfully acquiring a commercial license for an 8-acre plot. The alleged fraud traces back to a Letter of Intent submitted by Gehlot in 2001, seeking to transform a proposed housing development into a commercial colony without informing the complainants.
The prosecution argued that the accused’s actions constituted a deliberate act of criminal conspiracy and cheating, violating Sections 120B and 420 of the Indian Penal Code. Despite the serious nature of the charges, Gehlot was never arrested by the CBI during the investigation.
Gehlot’s defense team argued that since the investigation had concluded and Gehlot had cooperated throughout, there was no reason to deny bail. The court, referencing multiple Supreme Court rulings, agreed that Gehlot’s cooperation and the absence of an arrest during the investigation warranted his release on bail.
The decision comes with the understanding that the chargesheet has already been filed, and the trial will proceed without further need for detention.
With these considerations in mind, the court granted bail under strict conditions.
