The Delhi High Court has rejected an insurer’s argument that a driver escaped liability because a stray dog created an ‘agony of the moment’. Justice Anish Dayal held that Indian road conditions require motorists to anticipate stray animals and maintain sufficient care, alertness and control. The driver’s attempt to avoid the dog ended with the vehicle striking a divider and catastrophically injuring a rear-seat occupant, who later died. Applying the civil standard used in motor-accident claims, the court declined to disturb the tribunal’s negligence finding. It also upheld compensation for attendant charges, future care and medical expenses, relying on testimony and payment records concerning the claimant’s prolonged unconscious condition. The insurer’s appeal was dismissed on 5 October 2026, and the remaining compensation with interest was ordered released.
