Widow’s Limited Estate Becomes Absolute Under Succession Law

India’s Supreme Court has held that a widow’s limited estate in agricultural land became an absolute ownership right under Section 14(1) of the Hindu Succession Act, 1956.

In Sultan Singh v Financial Commissioner, decided on 9 October 2026, the Court said the Delhi Land Reforms Act’s reference to personal law incorporated later changes made by the succession statute. Khajano’s pre-existing maintenance interest therefore matured into full ownership, allowing her sons to inherit after her death.

The Court rejected the argument that Section 14 could not affect rights created before the 1956 Act. It dismissed the appeal and upheld the succession claimed through Khajano.
