The Karnataka High Court has granted bail to a man charged under Section 69 of the Bharatiya Nyaya Sanhita, finding that the complainant’s own statement placed the alleged promise of marriage after the sexual relationship began.
Justice S. Vishwajith Shetty said the provision applies where intercourse is induced by deceitful means or a promise to marry made without any intention of fulfilment. On the prosecution material, that sequence was not shown at this stage. The court also noted that the investigation was complete, a charge sheet had been filed, and the accused had no criminal antecedents.
The order, delivered on 1 October 2026, requires a ₹1 lakh bond with two sureties. It also bars the accused from tampering with evidence, threatening witnesses, committing similar offences or leaving the trial court’s jurisdiction without permission.
