The Sikkim High Court has condoned a 223-day delay in a civil revision but imposed costs after the applicant advanced an unverified and later withdrawn explanation blaming former counsel.
Justice Bhaskar Raj Pradhan applied a justice-oriented approach to limitation, finding that the dispute should be heard on merits despite the defective pleading. The court stressed, however, that litigants must approach courts promptly and cannot casually attribute delay to a previously engaged advocate without proper verification.
The application was allowed subject to payment of ₹50,000 to the Sikkim State Legal Services Authority for rehabilitation of POCSO victims. The order was delivered on 8 October 2026.
