The Allahabad High Court has upheld prosecution sanction in a corruption case, rejecting an argument that an earlier internal view amounted to a final refusal.
Justice Subhash Vidyarthi held that the competent authority could accept advice from the Central Vigilance Commission and reconsider the matter on fuller material. The earlier departmental communications were not a conclusive order declining sanction, and disagreement with vigilance advice would have required referral under the applicable process.
The court found prima facie material supporting cognisance and no failure of justice in the sanction decision. It dismissed Jay Pratap Singh Chauhan’s petition challenging the proceedings on 8 October 2026, leaving the evidence for assessment at trial.
