The Madras High Court has granted bail to a man accused in a ₹2.62 crore coaching-deposit case after finding that police failed to provide written grounds for his arrest.
Justice N. Ramesh held on 7 October that an arrest memo containing only general statutory phrases did not explain the factual basis for detention. An oral explanation could not cure that defect, particularly where the memo was in a language the accused could not read.
The court said Supreme Court precedent requires written grounds in a language understood by the arrested person. It directed Tamil Nadu’s police leadership to treat non-compliance as dereliction of duty capable of attracting departmental proceedings.
Bail was granted subject to financial security, cooperation with the investigation, travel restrictions and witness-protection conditions. The police chief was also asked to report on statewide instructions and officer training.
