Forged Writ Filings Justify Summary Dismissal, Gauhati High Court Warns

The Gauhati High Court has dismissed Nurul Hoque’s challenge to a Foreigners Tribunal opinion declaring him a foreigner who entered India after 25 March 1971.

In its 12 October 2026 judgment, the court found that copies of the written statement and evidence affidavit filed with the writ petition materially differed from the Tribunal record. It described the use of forged or fabricated pleadings to mislead the court as sufficient ground for summary dismissal, although it still examined the citizenship claim on its merits.

The bench held that the Tribunal had properly assessed the evidence and that Hoque failed to discharge the statutory burden of proving Indian citizenship. It recalled his interim bail, allowed the Tribunal’s consequences to follow, and directed that copies of the writ filings and vakalatnama be sent to the relevant Bar Council.
