The Delhi High Court on 27 October 2026 set aside the education department’s order treating Bindu Khanna as a TGT from 1994 and PGT from 2006.
Judge / Bench — Justice Sanjeev Narula (author).
It found inconsistent school records insufficient to establish those appointments. The department must verify dues based on service as Assistant Teacher from January 1994 and placement in the TGT grade from April 2003. Legally recoverable arrears will carry 6% simple interest. Khanna need not repay amounts already released, even if they exceed verified dues. The contempt case was disposed of; an existing ₹50,000 costs order remains enforceable.
Advocates appearing — School in both matters — Kamal Gupta, Tripti Gupta, Sparsh Aggarwal and Siddharth Arora, Advocates; Director of Education (respondent 1) — Not named in the judgment. Party in person — Bindu Khanna, respondent 2 in the writ and petitioner in contempt.
