The Supreme Court on 5 November 2026 restored G. Pazhanivel’s civil suit after finding that courts had wrongly rejected his plaint by entering into its merits.
Judge / Bench — Ujjal Bhuyan and Atul S. Chandurkar, JJ.; judgment by Atul S. Chandurkar, J.
In Civil Appeal 13154/2026 (2026 INSC 1197), the Court held that Order VII Rule 11 CPC can operate before registration. However, the plaint must be read meaningfully as a whole; anticipated failure at trial is insufficient. The suit will proceed without the Court’s observations deciding its merits. Pre-registration rejections must be recorded in the prescribed register; High Courts may amend applicable rules where necessary.
Advocates appearing — Appellant: Shoeb Alam, Senior Advocate; respondent: G. Indira.
