Madhya Pradesh High Court Rejects Family Claim Over Partitioned Land

The Madhya Pradesh High Court upheld the dismissal of a suit by a wife and two sons who claimed title to land that Ramswaroop had received on partition. The court decided Prembai and others v. Ramswaroop and others on 26 October 2026.

Judge / Bench — Ashish Shroti, Judge.

Applying the Hindu Succession Act and Supreme Court precedent to the pleaded facts, the court treated the allotted land as Ramswaroop’s separate property. It held that the plaintiffs had no claim to it during his lifetime and dismissed the appeal because it raised no substantial question of law.

Advocates appearing — Appellants: Ashish Shrivastava. Respondent 2 (State): Rajendra Jain, Government Advocate. Other respondents: Not named in the judgment/order.
