The court held that authorities could not continue using a notification and its parent provision after a Division Bench had struck them down. Pending Supreme Court challenges carried no interim stay. It directed Sub-Registrars to register transfer deeds satisfying statutory requirements and ordered a compliance circular. Registration itself, the court cautioned, does not cure defective ownership.
