The Allahabad High Court has appointed two advocate commissioners to inspect a Ghaziabad housing project after flat owners alleged that possession was delivered without a completion certificate and construction departed from the sanctioned plan.
The residents challenged compounding approvals granted by the development authority, contending that additional dwelling units reduced common areas and that extra floors were built unlawfully. Those allegations were disputed by the developer and public authorities.
Rather than decide contested facts on affidavits, the Court directed an on-site inspection to establish the project’s physical condition, the extent of occupation and any divergence from approved plans. The order provides an evidentiary foundation for the next hearing while preserving the parties’ substantive claims.
