Court Tightens Grip: Non-Bailable Warrants Issued for Real Estate Moguls

In a recent turn of events, the East Delhi District Consumer Disputes Redressal Commission has issued non-bailable warrants against the directors of Parsvnath Developers. The real estate company has been found to be intentionally evading a court-ordered payment to a homebuyer, stemming from a failure to deliver an apartment as promised.

The homebuyer had initially booked the apartment in 2008, paying ₹8,10,000 upfront with assurances of possession within two years. Despite these assurances, Parsvnath Developers failed to hand over the property for a staggering decade. Frustrated and seeking justice, the homebuyer turned to the district consumer court.

In July 2023, the district consumer rights forum ruled against Parsvnath Developers, ordering the return of the ₹8,10,000 with interest, an additional ₹25,000 for service deficiency, and ₹10,000 for litigation costs. The developer was given 30 days to comply but failed to fulfill this obligation.

The situation escalated when, in July 2024, a bench led by forum President Sukhvir Singh Malhotra and member Ravi Kumar issued non-bailable warrants after observing that the company was deliberately avoiding payment. The developers managed to pay ₹2,00,000 but subsequently failed to appear in court, prompting the severe measure.

The case is set for further hearing on August 7, with advocates Swati Aggarwal and Yogita Yadav representing the homebuyer. The consumer court’s firm stance underscores its commitment to ensuring accountability in the real estate sector.
