Delhi High Court Affirms Mandate for Health Warnings on Pan Masala Packaging

In a decisive ruling, the Delhi High Court has upheld a significant mandate requiring pan masala manufacturers to prominently display health warnings covering 50% of the front packaging space. The regulation, introduced by the Food Safety and Standards Authority of India (FSSAI), aims to educate consumers about the risks associated with consuming pan masala.

Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora emphasized the public health benefits of the regulation, dismissing challenges from manufacturers like Dharampal Satyapal Limited. The court’s verdict underscored the proportionality of enlarging warning statements from 3mm to half the front label size, affirming its alignment with broader public health objectives.

The petitioner-company contended that the regulation violated constitutional rights and lacked scientific justification, but the Division Bench concluded that the measure served the paramount public interest, distinguishing it from regulations on alcohol products. Advocates representing both sides presented their arguments vigorously, highlighting the complexities of balancing commercial interests with public health imperatives.

This ruling underscores India’s ongoing efforts to regulate products affecting public health, setting a precedent for transparency and consumer awareness in the food industry.
