In a significant win for Kiranakart Technologies, the Delhi High Court has ordered the removal of an older ‘ZEPTO’ trademark registered in 2014, clearing the way for the company to claim exclusive rights to the brand.
The dispute arose when Mohammad Arshad, who had registered ‘ZEPTO’ under advertising and retail services, opposed Kiranakart’s trademark application. Arshad, however, failed to substantiate any real commercial use of the mark, leading the court to rule in favor of the quick-commerce startup.
Justice Amit Bansal highlighted that Kiranakart has been actively using and promoting ‘ZEPTO’ since 2021, while Arshad’s claim had remained dormant for nearly a decade. With no evidence of genuine use, the court deemed his trademark an unjustified obstacle and ordered its removal from the official register.
With this decision, Kiranakart solidifies its hold on the ‘ZEPTO’ brand, ensuring uninterrupted use as it continues expanding its rapid delivery services across India.
