The Delhi High Court has officially recognized ‘Peter England’ as a well-known trademark, solidifying its status as one of India’s most recognizable menswear brands. The ruling came in response to a trademark infringement case involving Aditya Birla Fashion and Retail Limited, the company that owns the brand, against an entity found to be using the name unlawfully.
The Court acknowledged the brand’s widespread presence, citing its 380 outlets across 180 cities and significant sales figures over the past decade. It highlighted that ‘Peter England’ has not only sustained extensive growth but has also received numerous accolades, further cementing its reputation.
Observing that the brand had become inherently distinctive and was directly associated with Aditya Birla, the Court concluded that it met all legal criteria to be declared a well-known mark under trademark law. The verdict follows an interim relief granted in July 2024, which had already barred the defendants from using the ‘Peter England’ name on their signage or invoices.
Originally introduced in India in 1997, ‘Peter England’ traces its roots back to 1889 when it was first established in England. Acquired by the Aditya Birla Group in 2000, the brand has since been endorsed by high-profile figures, including Bollywood actor Ayushmann Khurrana and players from the Chennai Super Kings cricket team.
With this ruling, ‘Peter England’ now enjoys a heightened level of legal protection, reinforcing its exclusivity in the fashion industry.
