Delhi High Court Weighs Survey to Assess Demolition Impact in Jamia Nagar

The Delhi High Court signaled on Friday that it may order a survey of the Dhobi Ghat area in Batla House to determine the extent of impact from the ongoing demolition drive.

A Division Bench, comprising Chief Justice Devendra Upadhyaya and Justice Tushar Rao Gedela, was hearing a petition from the Dhobi Ghat Jhuggi Adhikar Manch, a group advocating for residents of the informal settlement. The union is challenging a prior court ruling that declined to halt the demolitions.

The Court questioned the petitioner’s ability to represent the affected residents, asking, “Who are the residents, and how do you establish that? Who are you, and who benefits from your petition?” Given these uncertainties, the Bench indicated that a survey could be necessary to clarify the situation.

The demolition drive stems from concerns that the settlement encroaches on the Yamuna floodplains, raising environmental and legal issues. Authorities initiated demolition efforts in 2020, arguing that no habitation is allowed in the area. Residents, however, contend that they received no prior notice and were offered no compensation or alternative housing. They claim the demolitions have left the area in disarray, with stagnant water worsening environmental conditions.

A single-judge Bench previously upheld the demolition, siding with the Delhi Development Authority (DDA), which maintains that any encroachment on the floodplains disrupts the river’s flow and increases flood risks. The ruling dismissed the petition, asserting that unauthorized occupants had no legal claim to rehabilitation. The Court also imposed a ₹10,000 penalty on the petitioner union.

Now, the residents have taken their fight to the Division Bench, fearing further demolitions. Their legal counsel argued that nearly 800 homes have already been razed, while the DDA reiterated that the settlement is not listed for rehabilitation under government policies.

As the case progresses, the Court’s potential order for a survey could play a key role in determining the fate of those affected by the demolition drive.
