The Supreme Court has closed Amalgamated Fuels’ challenge after the company accepted that its dispute with Bharat Petroleum Corporation should proceed before the Commercial Court.
The company told the Court it was willing to institute the suit contemplated by the Calcutta High Court’s order. BPCL, represented by the Additional Solicitor General, responded that it would not object to the suit as non-maintainable.
On those assurances, the Court disposed of the special leave petition while expressly preserving Amalgamated Fuels’ liberty to bring the commercial action.
The order does not decide the contractual merits. Its significance is procedural: the dispute will now move to a specialised trial forum, with one threshold objection removed, allowing the parties to address evidence and contractual liability directly.
