Gourab Banerjee Tapped as Arbitrator in High-Stakes Investment Clash between CTF Holdings and Ukraine

In a notable development within international investment arbitration, Gourab Banerjee has been appointed by Luxembourg-based CTF Holdings SA as its nominee arbitrator in a Bilateral Investment Treaty (BIT) arbitration case against Ukraine. This dispute, now in proceedings before the International Centre for Settlement of Investment Disputes (ICSID), has drawn attention to the ongoing complexities of cross-border investments under BIT frameworks.

Banerjee’s appointment places him as only the second Indian, following the late Fali Nariman, to be named as an arbitrator in an Investor-State dispute under ICSID’s auspices. Although India itself is not a signatory to the ICSID Convention, the arbitration body remains a prominent forum for resolving international investment disputes, backed by the World Bank Group. With 158 states party to the ICSID Convention since it came into force in 1966, ICSID remains a critical venue for addressing such high-stakes, multinational investment cases.

This appointment underscores Banerjee’s significant role within the global arbitration community, marking another milestone in international arbitration with an Indian representative at the forefront.
