The Supreme Court has taken a significant step to safeguard the legacy and management of the historic Oachira Parabrahma Temple in Kerala. In a landmark move, a retired Kerala High Court judge has been appointed to oversee fresh elections for the temple’s administration, ensuring transparency and fairness in managing its sprawling 21.25-acre premises and its affiliated institutions, including a hospital and nursing college.
This temple, a unique cultural marvel without a traditional idol or sanctum, has long been governed by a three-tier committee. Legal disputes over administrative reforms, stemming from a 2006 suit, led to interim measures and eventually escalated to the current judicial intervention. Recognizing the temple’s cultural and historical significance, the Court emphasized the urgent need to preserve its sanctity and protect its properties.
The bench, led by Chief Justice Sanjiv Khanna, underscored the importance of restoring robust governance under judicial oversight. “Preserving ancient temples like Oachira is imperative, not just for their spiritual value but for their role as community pillars,” the judgment stated.
A Clear Mandate for Order
The retired judge, Justice K. Ramakrishnan, has been tasked with organizing elections within four months. To aid this process, the Court authorized him to appoint a retired district judge and a legal professional, ensuring the smooth execution of his duties. The honorariums for these roles, as well as election-related expenses, will be drawn from temple funds.
Additionally, the Court laid down strict instructions for the newly appointed administrator:
- Finalize and publish the voter list, adhering to the temple’s bylaws.
- Oversee the smooth handover of responsibilities from the previous administration.
- Manage temple affairs until the elected body assumes control.
The trial court overseeing the broader administrative reform case was urged to expedite its proceedings.
